Peru VIP Travel wants you to enjoy your holiday successfully. Please take the time to read and understan our detailed terms and conditions below and agree to enter into travel service contracts with us.
1. The contract
The contract is stipulated between Peru VIP Tours (us) and the Customer, which includes all the persons indicated in the booking form. The person who signs the booking form guarantees to have full authority on behalf of all the people whose names appear on it and confirms that all those people are fully aware and accept these conditions.
2. Prices & Surcharges
Peru VIP Tours reserves the right to increase the cost of the tour to take into account the following elements: government action, monetary fluctuations, transportation costs (including the cost of fuel), food increases, airport charges and increases in air fares scheduled or any other increase that is beyond our control. All prices are based on US dollars. If the price increases, Peru VIP Tours will absorb the price increase only if the price increase is less than 4% of the total package price. If the increase is greater than 4%, the customer will be charged 100% of the difference with the original price.
3. Deposit requirement to confirm a reservation
- A deposit of 50% of the total cost of the trip per person is required to confirm a reservation.
- All flights (national and international) must be paid in advance to secure the spaces.
- Receipt of payment on account; It implies the reservation, subject to availability of the places and services requested.
- If the reservation is made 30 days or less before departure, full payment must be paid.
4. Full payment & Booking reconfirmation
- The balance of the amount of the trip must be paid 30 days before the start date of the provision of our services.
- As soon as we receive the full payment; We will send you an email re confirming your reservation.
- If the reservation is made within 30 days before the start of the trip, full payment must be paid.
- If the total payment or the balance of payment is not paid on the due date or before, we reserve the right to treat your reservation as canceled.
5. Cancellation by the client
Any cancellation by the Client must be made in writing and Peru VIP Tours must acknowledge it in writing. The date on which Peru VIP Tours or its Travel Consultants receive the cancellation request will determine the applicable cancellation fees:
- More than 45 days or more days before its commencement, the entire deposit will be refunded, less $ 200 per passenger of administrative expenses.
- From 45 to 30 days from the start date, 25% of the total amount of your trip will be withheld.
- From 30 days to 15 days from the start date, 75% of the total amount of your trip will be withheld.
- Less than 15 days from the start date, 100% of the total amount of your trip will be withheld.
- If the Inca Trail was planned, we will retain the sum of $ 170 USD to cover the registration fees.
Special notes
- Payments or deposits for flight reservations are not refundable due to airlines.
- In case of postponing the trip, an administrative fee of 20% of the price of the trip will be charged plus the amount already spent on subcontracted non-refundable services. The remaining amount can be used for future trips with Peru VIP Tours.
- No refund will be made if you voluntarily leave a trip for any reason after the trip has begun. Refunds will be at the discretion of Peru VIP Tours, if you are involuntarily forced to leave a trip for any reason. No refunds will be made for accommodation, transportation, tourism, meals or services not used.
- It is strongly recommended that full insurance be contracted, which includes coverage, in certain circumstances, against loss of deposit or cancellation fees.
6. Personal information of the client
- In order for Peru VIP Tours to confirm and guarantee the Customer’s travel arrangements, the Customer must provide all the Customer Details with their full payment.
- If the Client does not provide all the details 60 days or more before departure, an administrative fee will be charged.
- In the event that Peru VIP Tours has not received the client’s information 30 days before the departure of the client’s trip, Peru VIP Tours reserves the right to treat the file as canceled and full cancellation fees will apply. The required customer details will vary from one tour to another, and will be informed during the reservation process. However, at a minimum, the client’s details include the passport number, the expiration date of the passport, the full name as it appears on the passport with which you are traveling, the date of birth, the place of birth, the nationality and Arrival details (or other documents requested by Peru VIP Tours) A reservation cannot be confirmed without providing the Customer Details.
7. Cancellations & Changes for Peru VIP Tours
- While Peru VIP Tours will do everything possible to operate all tours as announced, when entering into this contract, the Client accepts that it may be necessary or advisable to vary or modify a travel itinerary or its content due to current local conditions.
- Due to unforeseen and unusual circumstances beyond the control of the company, the consequences of which could not have been avoided even if all due care had to be exercised. The company will make every effort to minimize the effects of matters beyond its control, but cannot accept any responsibility for these matters that include political disputes, border closures and visa refusals, industrial actions, delayed flights, unpredictable weather, strikes, war, civil unrest, natural disasters, government actions, mechanical failures or any act beyond our control. Peru VIP Tours reserves the right at any time to cancel or change any of the facilities, services or prices (including flights, accommodation or other arrangements) and substitute alternative arrangements of comparable monetary value and without monetary compensation or money reimbursement; and accepts no responsibility for loss of enjoyment as a result of these changes. The client accepts to assume all the additional costs derived from any of these factors.
- We are not responsible for any incidental expenses you may have incurred as a result of your reservation, such as visas, vaccinations or non-refundable flights.
8. Payment methods
- Credit and debit card
We accept VISA, MasterCard, AMEX and Diners Club through this payment method, taking into account that a 6% commission will be added for the use of the platform. - Bank transfer
You can transfer funds directly from your own bank account to our bank account. Taking into account the bank fees, in charge of the total amount of the transfer. We will send you the details of our account once you confirm the trip. - Western Union
We accept payments through Western Union; through this payment method, Western Union charges a minimum commission according to your city where you must pay it.
9. Changes by the client
- For any change by the customer to the itinerary after receiving a confirmed travel invoice from Peru VIP Tours, a change fee of US $ 40 will be charged plus any costs or charges incurred or charged by our suppliers as a result of the amendment While all reasonable efforts will be made to accommodate additional changes and requests, their availability cannot be guaranteed.
- Any changes made by the Customer must be made within 45 business days before the trip leaves; otherwise, Peru VIP Tours will reserve the right to accept or reject the suggested modifications according to the availability of tourism companies: accommodation, tour operators and transport.
- Changes in reservations made 44 business days before the trip will not be accepted.
- Any changes to the original reservation must be confirmed by the person signing the reservation form..
10. Customer Replacement
- If any member of your group cannot travel, it is possible to transfer the reservation to another suitable person, provided that a written notice is sent at least 45 days before departure. An administrative fee of US $ 50 plus the costs imposed by the Peru VIP Tours providers will be charged.
- For the Inca Trail, any information such as dates, name and passport number is not possible after a permit has been processed. A permit is not transferable or refundable. The deposit will be lost. Please note that we do this because we are prohibited from reselling your permission after we have canceled it.
11. Medical conditions & Special requirements
The Client must notify Peru VIP Tours in writing during the reservation process of any medical condition, pregnancy, disability or any other mental or physical condition that may affect the ability to travel or any medical condition. If Peru VIP Tours is not notified, the Customer’s trip can be rejected. If Peru VIP Tours is not notified of any conditions that result in cancellation, full cancellation fees will apply to the Client. Some trips may not be suitable for Clients due to their age, mobility, disability, pregnancy or physical or mental conditions. It is the Customer’s responsibility to verify before booking. Peru VIP Tours may refuse to transport pregnant women for 24 weeks or clients with certain conditions. Peru VIP Tours is not required to provide special facilities unless you have agreed to do so in writing. Peru VIP Tours will make every effort to satisfy the special requests of the Clients, including the diet, but such requests are not part of the Contract and, therefore, Peru VIP Tours is not responsible for not providing these requests. Medical facilities vary from one country to another and Peru VIP Tours does not make representations and does not offer guarantees in relation to the standard of such treatment.
Travel with children
Customers 18 years old on the date of the first trip are considered adults. An adult over 18 must accompany every 2 children under 18. The proportion of adults and children traveling together must be one adult for two children and two adults for four children (17 years and under). The minimum age for Clients traveling on tours is 12 years (for tours designated by the Family, the minimum age is 5). All inquiries regarding children are subject to review and approval by Peru VIP Tours, which reserves the right to restrict the number of travelers under 18 on tours.
12. Passports, visa and vaccinations
It is the Customer’s responsibility to have a valid passport and carry it throughout the trip to show at the checkpoints required by the destination of the visit, visa permits, vaccinations and preventive medications that may be necessary for the duration of the Tour. Information on these matters or related articles is provided in good faith but without responsibility by Peru VIP Tours.
13. Age fitness and participation
- It is expected that all Clients will be satisfied before the reservation that they are fit and that they can complete the itinerary of their choice. Persons over 60 years of age will be advised to obtain medical evidence of their ability to travel on the chosen itinerary.
- Unaccompanied minors (under 18 years of age) cannot be accepted on tours operated by Peru VIP Tours, however, older adolescents may be considered provided they are accompanied by a parent or guardian who accepts full responsibility for them.
- Peru VIP Tours reserves the absolute right to refuse a reservation at its discretion. Clients agree to accept the authority and decisions of employees, travel leaders and travel consultants of Peru VIP Tours, while on tour with Peru VIP Tours.
- If, in the opinion of said person, the health or conduct of a Client before or after departure seems to jeopardize the safe, comfortable or happy progress of a tour, the Client may be excluded from all or part of the tour. In case of illness, Peru VIP Tours can make the arrangements it deems appropriate and recover the costs of the Client.
14. Local laws
All participants in the tours operated by Peru VIP Tours are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve Peru VIP Tours of all obligations that they might otherwise have under these booking conditions.
15. Illness or disability
Any person who suffers from a disease or disability or who undergoes treatment for any physical or medical condition must declare the true nature of said condition at the time of booking and make arrangements for the provision of any medication or other treatment that may be required. During the tour. Failure to comply with said disclosure will constitute a breach of these booking conditions and will result in said persons being excluded from the tour, in which case all the money paid will be lost. If the chosen holidays include an excursion or transfer by boat of any kind, the Client must inform him at the time of the reservation if he cannot swim. This will not prevent the Client from participating in the tour, but will allow Peru VIP Tours to take additional precautions for the Client’s security at the appropriate times.
16. Travel insurance
It is necessary to have travel insurance. Peru VIP Tours strongly recommends having travel insurance for all our travelers. Your travel insurance must provide coverage against personal accidents, death, medical expenses and emergency repatriation with a minimum recommended coverage of US $ 100,000 for each of the heads of coverage. We also strongly recommend that you cover cancellation, reduction, personal responsibility and loss of luggage and personal effects.
You must present proof of your travel insurance 15 days before the trip leaves.
In case you do not consider it necessary or do not need travel insurance; You must sign an affidavit stating that you do not need travel insurance and will be responsible in case of inconvenience during the trip.
17. Flight reservations
Peru VIP Tours will do everything possible to ensure that all flight prices are correct at the time they are quoted. Airlines reserve the right to modify or withdraw fares without prior notice. Once a deposit is paid on an airfare, it is guaranteed that a reservation will be maintained for you, it DOES NOT GUARANTEE the fare.
The fare can only be guaranteed when the flight reservation has been paid in full and a ticket has been issued.
Flight reservations cannot be transferred. The flight schedules offered by Peru VIP Tours are for general guidance only and are subject to change. Updated flight schedules will be shown on tickets.
The Client must check the tickets very carefully immediately after receiving the latest schedules. Peru VIP Tours will endeavor to inform the Client as soon as possible in case of any flight alteration.
The details of the airlines are also subject to change. Such modifications do not constitute a significant change in travel arrangements and, therefore, will not be entitled to cancel without paying normal charges as a result.
Peru VIP Tours is not responsible for any delay in your flight, whether due to adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, reprogramming of flight times by of the airline, mechanical breakdown, strike, industrial action or any other reason.
18. Customer Responsability
- Customers agree to accept the authority and decisions of employees, travel leaders and travel consultants of Peru VIP Tours while on tour with Peru VIP Tours. If, in the opinion of such persons, the health or conduct of a client at any time before or after departure seems to jeopardize the safety, comfort or happy progress of a tour, then the client may be excluded from everything or part of the tour.
- In the case of health problems, Peru VIP Tours can make the necessary arrangements and recover the client’s costs. If a client commits an illegal act, he / she may be excluded from the tour and Peru VIP Tours will cease to have responsibility for / for them. If you are affected by a medical or other condition that may affect the enjoyment of other people or the active participation of the tour, you must inform us at the time of booking.
- No refund will be granted for unused services. Customers must be in possession of the passport to show at the control sites where they will visit, and are responsible for organizing a valid passport, visa if applicable and any certificate of vaccination required for the entire trip. Information on these matters or related items (weather, clothing, luggage, etc.) is provided in good faith, but Peru VIP Tours is not responsible for any of this information.
19. Responsibility of Peru VIP Tours
- Peru VIP Tours is organized by order and account of our travelers, with their names, transportation, accommodation and other tourist services required, so we are not responsible in case of accidents, loss of personal property effects during the subcontracting of services such such as: during the services of the tour guide, on the bus, in the hotels, in the restaurants, during the walks, in the camp, etc., delays or interferences with the tour, due to the strength of the main reasons why We have no direct responsibility.
- Peru VIP Tours is not responsible for illness, maternity, physical or mental impairment, which may jeopardize the health or integrity of the traveler or third parties during the trip. We will not assume any claim or refund due to the reasons mentioned above.
- Peru VIP Tours will not pay compensation if you are forced to cancel or change your route due to war, threat of war, disturbances, civil conflicts, industrial disputes, natural disasters, fires or adverse weather conditions, epidemics or health risks, technicians or maintenance problems with transportation, airports or ports that are closed or congested, changes imposed by the rescheduling or cancellation of airline flights, the alteration of the types of airlines or planes, or similar events beyond the control of Peru VIP Tours.
- Peru VIP Tours will not accept responsibility for changes in the flight schedule or the departure airport, as it is the responsibility of the airline. However, we will strive to minimize its effects on your trip.
- We cannot accept responsibility for delays on any of your flights, whether the cancellation or delay is caused by adverse weather conditions, airline rescheduling, airport authority and / or air traffic controllers action, breakdown Mechanical or industrial action. When delays on extended flights cause loss of vacation time, hotels or suppliers do not grant refunds. Similarly, airlines do not offer compensation for flight delays. However, at their discretion, carriers will endeavor to reduce the inconvenience of any delay in providing meals and accommodation, as appropriate for the time of day or night (depending on local availability). If you incur payments for such services in case of delay.
- Peru VIP Tours will not accept responsibility for payment unless we have given our prior consent. We request to inform us before the agreement of our services, about any limitation of this nature, in order to recommend special services that contemplate existing impediments.
20. If the client if the client has a complaint?
If the Client has a complaint about any of the arrangements of the tour, he must inform the tour leader or another representative of Peru VIP Tours at the time so that they can do everything possible to rectify the situation. Only if Peru VIP Tours is informed of any problem, will there be an opportunity to fix things. Complaining to Peru VIP Tours when a problem arises during your trip will allow us to remedy the situation or facilitate compensation. If the problem remains unresolved, a written complaint must be submitted to Peru VIP Tours within 28 days after the end of the vacation. 21. Financial security
Peru VIP Tours is a travel agency accredited by the Ministry of Tourism in Peru and has a Tourist Operator license from the Ministry of Foreign Trade of Peru (DIRCETUR) license number 09293 that requires total compensation insurance and a bond Total to comply with all laws related to the international travel business. 22. Photography and testimonials
If we insure or take any image of you during the tour, we have the right to use it in our advertising campaigns without any charge. This includes all kinds of promotional material such as slides, video programs, brochures and the Internet. If you have provided us with a written comment, then that can also be used for promotional purposes.
23. Privacy Policy
The company will use the personal information you provide to make all travel arrangements. As such, we will have to pass it on to our suppliers and carriers so that we can enable the operations of the services you have requested. However, we will strive to protect your information and use it for official purposes only for those that are extremely necessary.
